Terms & Conditions

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with WARRIORGENICS INC., hereinafter referred to as “Warriorgenics”, ”us ” or ”we”, at the Warriorgenics website, or mobile website (jointly referred to as  ”warriorgenics.com”).

By using warriorgenics.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order.

Only persons of legal age, 18 or 20 years, or older depending on your place of residency, who are not under guardianship, and are not acting in capacity as a company, with a physical address in one of the countries that Warriorgenics provides deliveries to can place an order. 

The terms might be amended from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on warriorgenics.com at the time you place your order.

Warriorgenics wants to provide the best possible shopping experience online. To make this possible we need to ensure that our operations can run smoothly. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the warriorgenics.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

Prices and delivery charges
The prices displayed at warriorgenics.com do not include shipping & delivery charges (unless otherwise indicated, i.e. special shipping promotions on certain products as designated on warriorgenics.com site, direct communication from us to the customer, or as promoted on our owned social media accounts).
The price does not include import taxes or custom duties. Import taxes/custom duties will be charged by your carrier at delivery and Warriorgenics does not compensate these charges.

The delivery charge for each order will be determined by weight of your order with lower fees on order weights above a certain threshold (as communicated at check-out). The cost for each delivery method is clearly indicated during the check-out process. Special notice: The impact of COVID has brought many supply-chain and shipping delays along with delivery constraints. Accordingly, if we are unable to deliver your order in full in one shipment, we may have to make more than one delivery. You will receive all pertinent information by email/SMS (depending on your designated communication preferences) in these circumstances.

Ordering/conclusion of contract
The ordering option available to you is via warriorgenics.com. 
Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. Warrriorgenics and its partners will fulfill the order in accordance with the email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you and ask you to contact Warriorgenics Customer Care who will be able to settle the refund.

Delivery
Warriorgenics acts on every delivery with diligence, and with the utmost care to providing a seamless experience. This applies to accepting and processing orders. We work with the best shipping fulfillment entities worldwide in order to deliver your order in accordance with your selected delivery option.

Warriorgenics strives to dispatch orders in the fastest possible time, using our First in First Out (FIFO) approach and in the order in which orders are placed. Due to the current pandemic, delays may occur and it is impossible to guarantee delivery within a fixed time window. We will always aim to deliver as quickly as possible following confirmation of an order. Though we aim to deliver within the time frame communicated to you after your order is confirmed, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 30 days, you may cancel your order.

Before we process payment your order, you will be informed of the expected delivery details. Once you have placed your order you will receive an email confirmation with your expected delivery details.

If your order does not arrive by the scheduled date, please contact Warriorgenics Customer Care. 

Withdrawal of Order
At this time, Warriorgenics will not be able to accept returns for any reason aside from damaged/defective goods received. In the case of items arriving damaged or defective, please take a photo of your items and contact Customer Care. In these circumstances, you may receive a refund on your order from the date you place the order until 30 days after receipt of the ordered items. We will provide a refund attempting to use the same method used to make the payment on your order as soon as possible and at the latest within 14 days of receiving your notice of damaged or defective items, provided we have received evidence of such damage or defectiveness on the items. Another payment method may be used for the refund, provided that you consent to such change; in any case this will not generate any additional charges.

If you do not wish to keep the items in your order, please understand we do not have the capacity to accept them. Please consider donating your items to charity or those in need in the region and locale in which you reside. 

The provisions set forth herein do not limit any applicable statutory rights.

Payment methods
You can pay for your items from Warriorgenics as set out below.

Payment before delivery
Credit card or debit card

You can enter your payment details at the time you place your order using a valid credit or debit card (VISA, AMEX or Mastercard). You can also pay using PayPal, or any regionally-based forms of payment designated at checkout. The applicable amount will immediately be reserved on your card. Warriorgenics reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks. Please note that any applicable bank charges will be borne by you.

Please note that we are unable to accept gift cards and merchandise cards as forms of payments via warriorgenics.com. In cases where refunds are authorized by Warriorgenics (damaged, or defective items), we will provide a refund attempting to use the same method used to make the payment as soon as possible and at the latest within 14 days of receiving your notice and evidence per above. Another payment method may be used for the refund, provided that you consent to such change; in any case this will not generate any additional charges..

You will receive the legally required invoice document in the Shipping Confirmation e-mail.

Our Liability
Nothing in these Terms shall exclude or limit Warriorgenics' liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

Warriorgenics accepts liability for death or personal injury caused by our negligence or that of our employees and partners. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or partners. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.

Warriorgenics is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to pandemic, fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on warriorgenics.com shall be limited to the total price of your order.

Colours and measurements
We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

An item’s measurements given on warriorgenics.com are only approximate values to give you a better understanding of the model or fit of that specific item, and not a definite guarantee of the actual measurements of the item you receive. The final measurements of an item may vary depending on the material used in its production.

Guarantee
If there are defects in the goods you have purchased, Warriogenics abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by contacting Customer Care without delay by email, or using the submission form on the Contact Us page on warriorgenics.com.

Assignment
Warriogenics reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.

Severance
If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

Ownership of rights
All intellectual property rights, such as trademarks and copyrights at warriorgenics.com remain with WARRIORGENICS INC. its licensors. Any use of warriorgenics.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Warriorgenics.
